Terms and Conditions for TiVo® Service Gift Cards Purchased Before November 15, 2006

This agreement explains the terms and conditions that will apply to your use of any gift subscriptions to the TiVo® service originally purchased before November 15, 2006 either from TiVo Inc. (“TiVo”), TiVo.com, or any TiVo authorized retailer, including subscription cards available at Best Buy Co., Inc. (“Best Buy”) (together “TiVo service gift subscriptions”), and constitutes a legally binding agreement between you and TiVo. By using the TiVo service gift subscription, you agree to all the terms and conditions in this agreement ("Agreement").

  1. TiVo service gift subscriptions do not expire.  No fees will be charged against TiVo service gift subscriptions.
  2. TiVo service gift subscriptions are valid only in the United States and redeemable only for a new subscription to the TiVo service or the TiVo Plus™ service pursuant to the terms and conditions set forth herein.
  3. TiVo service gift subscriptions are only valid when purchased from www.tivo.com or from a TiVo Inc. authorized retailer, including Best Buy Co., Inc. stores.
  4. TiVo service gift subscriptions are not redeemable, recoupable, or refundable for cash or credit unless otherwise specified herein.  TiVo service gift subscription cards cannot be returned to authorized retailers if the PIN code is altered or scratched off. 
  5. TiVo service gift subscriptions must be redeemed through the TiVo.com web site, http://www.tivo.com/activate, or via phone at (877) 367-8486, and are only redeemable toward a new activation of TiVo or TiVo Plus service. A credit card is required at time of activation.

    TiVo service gift subscriptions may not be redeemed toward: TiVo Basic™ service, DIRECTV DVR with TiVo service or any other service or product offered by TiVo Inc., TiVo.com, TiVo.com store, or its affiliates or authorized retailers. TiVo service gift subscriptions are only redeemable for applicable services as mentioned above that are sold in the United States.

    All DIRECTV products that use the TiVo service are solely supported and maintained by DIRECTV. DIRECTV provides all customer service, including service activation, customer account inquiries, and basic technical/troubleshooting support.
  6. Once activated, you cannot suspend or cancel your service, or receive a refund on any remaining balance of your subscription unless canceled within 30 days of TiVo service or TiVo Plus service activation.
  7. TiVo service gift subscriptions cannot be used to purchase another gift subscription or other TiVo merchandise or equipment.
  8. TiVo service gift subscriptions that have not been redeemed may be transferred and used toward the activation of any new TiVo or TiVo Plus service subscription.
  9. Any unused balance is non-transferable unless otherwise specified herein.
  10. TiVo service gift subscriptions, including gift subscription cards purchased at Best Buy, are not refillable.
  11. If your order exceeds the amount of your TiVo service gift subscription, you must pay the balance due with a credit card.
  12. Product Lifetime service gift subscriptions are only redeemable for Product Lifetime Service subscriptions.
  13. TiVo service gift subscriptions are not applicable toward a billing option change. They are applicable only toward a new TiVo service activation contract.
  14. TiVo service gift subscriptions may be applied toward multi-service discounts. Terms and Conditions apply for multi-service discounted pricing.
  15. If you cancel your subscription 31 days or more after you activate your TiVo service, no refund or credit will be given for any unused remaining balance on your TiVo service gift subscription.
  16. TiVo service gift subscriptions and their use on the TiVo.com web site are subject to the Conditions of Use and Privacy Notice of TiVo Inc.
  17. No early termination fee will be applied to cancellations of new TiVo service or TiVo Plus service subscriptions purchased with a TiVo service gift subscription.
  18. TiVo is not responsible for lost or stolen TiVo service gift subscriptions. The value of a TiVo service gift subscription that is lost, stolen, destroyed, altered or used without your permission will not be replaced or refunded.
  19. TiVo Inc. will have the right to cancel TiVo service subscriptions or request alternative forms of payment if a fraudulently obtained TiVo service gift subscription is redeemed with TiVo Inc.
  20. Except as prohibited by law, the risk of loss and title transfer to you once you have purchased a TiVo service gift subscription. If TiVo, Best Buy, InComm, or other TiVo authorized retailer reasonably suspects fraudulent use of a TiVo service gift subscription, the TiVo service gift subscription can be suspended without notice. Certain provision herein may not apply in your state. Gift subscription card cash value is 1/2 of one cent.
  21. IN THE EVENT A TIVO SERVICE GIFT SUBSCRIPTION REDEMPTION CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH TIVO SERVICE GIFT SUBSCRIPTION. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
  22. Purchase of a TiVo service gift subscription means you accept these terms and conditions. Any term of this TiVo service gift subscription purchase agreement deemed unenforceable shall be severable and the remaining terms enforced.
  23. These terms and conditions shall, without regard to principals of conflict of law, be governed by the laws of the state of California, save and except that the laws of the purchaser’s residence shall govern any issue regarding the enforceability of an expiration date, if any.
  24. TiVo Inc. reserves the right to change these terms and conditions from time to time at its discretion. TiVo service, programming, pricing, and terms subject to change without notice.
